Terms of Service
Effective Date: January 1, 2026. Last Updated: March 25, 2026.
Please read these Terms of Service carefully before utilizing our website, testing tools, purchasing training or certification programs, or engaging our digital accessibility audit and remediation consulting services.
1. Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you (whether individually or on behalf of an enterprise entity, “Client”, “User”, or “you”) and Digital Compliance Auditors (“DCA”, “Company”, “we”, “us”, or “our”), governing your access to and use of digitalcomplianceauditors.com (the “Website”), our software tools (including the Free Accessibility Checker and WCAG Pro Continuous Monitoring Scanner), the Certified Digital Compliance Specialist (CDCS) Program, and professional manual accessibility audit and remediation services.
By accessing our Website, creating an account, subscribing to any service, or purchasing any program or deliverable, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you are strictly prohibited from using this Website and our services.
2. Scope of Services and Product Lines
Digital Compliance Auditors operates across three primary service categories:
A. Professional Manual Audits and Remediation Consulting
Includes comprehensive WCAG 2.1 and WCAG 2.2 Level AA manual verification, Section 508 VPAT preparation, ADA Title III emergency defense audits, and engineering remediation support. All consulting engagements are governed by specific Statements of Work (SOW) or Master Services Agreements (MSA) executed between DCA and the client.
B. Automated Software and Monitoring SaaS (WCAG Pro)
Cloud-based automated accessibility scanning and continuous regression testing across up to 10,000 pages per domain. The automated scanner assists in detecting automated syntax violations but is not a substitute for human assistive technology testing.
C. The Certified Digital Compliance Specialist (CDCS) Program
Professional certification training offered in two distinct commercial tiers:
- Tier 1: Practitioner Pass ($497): Grants single-user access to self-paced curriculum, testing toolkits, and 1 official Practitioner Certification exam seat.
- Tier 2: Agency Commercial License & Partner Directory ($1,497): Grants curriculum access for up to 3 team seats, white-label client-facing PDF audit deliverable templates, remediation contract templates, executive presentation slide decks, and official verified registry listing on the DCA Partner Directory.
3. Professional Disclaimer and No Legal Representation
Any technical audits, VPAT documents, checklists, demand letter technical analysis, or white-label legal defense templates provided on this Website or as part of our services do not constitute formal legal advice. You should always consult qualified legal counsel admitted in your jurisdiction regarding formal legal responses to demand letters, settlement negotiations, court pleadings, or consent decrees.
4. Billing, Subscriptions, and Refund Policy
A. Software Subscriptions (WCAG Pro)
Subscriptions are billed in advance on a recurring monthly basis ($14/month or custom corporate tier). You may cancel your subscription at any time via your account dashboard. Cancellations take effect at the conclusion of the current billing cycle. No partial refunds or credits are issued for unused portions of subscription periods.
B. CDCS Program and Digital Deliverables
Because the CDCS Program provides immediate access to proprietary downloadable intellectual property, including proprietary testing toolkits, white-label PDF audit templates, contract agreements, and slide decks, all sales of the $497 Practitioner Pass and $1,497 Agency Commercial License are final and non-refundable once digital credentials and materials have been accessed or downloaded.
C. Manual Audit and Remediation Retainers
Engagements for high-ticket human audits, emergency demand letter defense audits, and remediation engineering are billed per the payment terms specified in the individual client contract. Retainer deposits secure auditor scheduling and are non-refundable once testing fieldwork has begun.
5. Limitation of Liability and Safe Harbor
Digital compliance and web accessibility are continuously evolving disciplines influenced by third-party browsers, screen reader variations, user configurations, and ongoing website updates made by your personnel.
To the maximum extent permitted by applicable law, Digital Compliance Auditors, its officers, directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, legal settlements, attorney fees awarded to third-party plaintiffs, or fines resulting from your digital assets.
6. Intellectual Property Rights
All content, curriculum materials, proprietary testing methodologies, code samples, logos, trademarks, and documentation provided on this Website are the exclusive intellectual property of Digital Compliance Auditors.
Purchasers of the CDCS Agency Commercial License are granted an irrevocable, royalty-free, non-exclusive license to rebrand, customize, and deliver white-label PDF audit reports and client contracts to their direct end clients. Reselling, sublicensing, or distributing the raw course curriculum or unbranded templates as a standalone product or template bundle is strictly prohibited.
7. Acceptable Use and Automated Scanning Policy
When using our Free Accessibility Checker or WCAG Pro scanner, you agree not to:
- Scan domains for which you do not own or possess explicit administrative authorization to test.
- Conduct denial-of-service attacks, flood requests, or attempt to reverse-engineer DCA scanning engines.
- Scrape, harvest, or aggregate DCA proprietary audit database records without prior written consent.
8. Governing Law and Dispute Resolution
These Terms of Service and any dispute arising out of or related to our services shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of law.
Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in the State of Delaware, and each party irrevocably submits to the exclusive personal jurisdiction of such courts.
